Effective from May 27, 2024, Hong Kong residents who have applied for Canadian permanent residence (PR) under the Stream A (in-Canada graduates) or Stream B (Canadian work experience) pathway can apply to extend their temporary status in Canada by applying for an open work permit (OWP) under a new public policy announced by IRCC.
This temporary public policy will allow PR applicants from Hong Kong to stay in Canada and be able to work while they are waiting for their PR application to be processed.
Do I Qualify to Apply for an Open Work Permit Under This New Policy?
This open work permit will be available to those who:
Permanent Residence Pathways for Hong Kong Residents with Effect Until August 31, 2026
Stream A Pathway: Stream A is a pathway that allows Hong Kong residents who have graduated from a Canadian post-secondary institution in the last three years to apply for permanent residence in Canada.
Stream B Pathway: Hong Kong residents who have fulfilled at least one year of full-time Canadian work experience (or the part-time equivalent of 1,560 hours) within three years before their PR application may apply for permanent residence in Canada.
When to Apply for the Open Work Permit
You may apply for this open work permit if your current temporary resident status will expire while you wait for your permanent resident application to be processed by IRCC.
This new policy will be in effect for five years until May 2029.
How About My Spouse and Children?
If you included your spouse and/or dependent minor children on your permanent residence application under the Stream A/Stream B pathway:
What if My Temporary Resident Status Has Already Expired?
If you are in Canada your temporary resident status expired less than 90 days ago, you are still eligible to apply for this open work permit. You will also need to apply to restore your temporary resident status when you apply for this open work permit.
However, if your temporary resident status has expired for more than 90 days before submitting an open work permit under this new public policy, your application will not be considered.
What Happens After I Submit This Open Work Permit Application? What Does it Mean to Have a Maintained Status?
If you have submitted this new open work permit application before your current work permit expires, you can keep working under the same conditions as on your current work permit and have legal status in Canada until a decision is made, even while this new open work permit application is being processed. This is referred to as "maintained status".
It is important to note that temporary residents will only have “maintained status” during processing only as long as they remain inside Canada.
